TERMS OF SALE

These Terms of Sale (“Agreement”) are entered into between Business In Motion Inc. (“Business In Motion – Bag PRO”), operating under the Bag PRO brand, located at 12081 Katy Rd. Suite 809, Fort Worth, TX 76244, United States, and the purchaser (“Buyer”).

1. Acceptance

All sales are subject exclusively to these Terms of Sale. By placing an order, Buyer accepts these Terms fully without modification or qualification.

2. Pricing and Payment

Prices are in U.S. dollars and subject to change without prior notice. Payment must be received by Business In Motion – Bag PRO prior to shipment unless otherwise agreed upon in writing.

3. Payment Terms

All transactions must be made by credit card. The Buyer certifies that they are the authorized holder of the credit card used for the purchase. Payment must be fully authorized by the card issuer before shipment of goods. In case of delayed payment or declined transaction, Business In Motion – Bag PRO reserves the right to suspend or cancel the order.

4. Shipping and Delivery

Delivery dates provided are estimates only. Business In Motion – Bag PRO is not responsible for delays caused by carriers, customs, or unforeseen circumstances beyond Business In Motion – Bag PRO’s control.

5. Product Availability and Out-of-Stock Items

Products displayed on the website are subject to availability. If the “Add to Cart” option is unavailable, the product is currently out of stock. Purchases cannot be made for products out of stock, and no back orders will be accepted. Availability will be updated on the website as soon as products are restocked.

6. Title and Risk of Loss

Title and risk of loss transfer to Buyer upon Business In Motion – Bag PRO’s delivery of goods to the carrier.

7. Returns and Warranty

Business In Motion – Bag PRO warrants that goods will be free from defects upon delivery. Buyer must notify Business In Motion – Bag PRO of any defects within 10 days of receipt. Business In Motion – Bag PRO’s liability is limited to replacement or refund at Business In Motion – Bag PRO’s discretion. Returns must be authorized by Business In Motion – Bag PRO in advance.

8. Limitation of Liability

In no event shall Business In Motion – Bag PRO be liable for indirect, special, incidental, or consequential damages arising out of this transaction.

9. Force Majeure

Business In Motion – Bag PRO shall not be liable for delays, non-performance, or cancellations due to circumstances beyond Business In Motion – Bag PRO’s reasonable control, including, but not limited to, acts of God, natural disasters, governmental regulations, war, terrorism, civil unrest, pandemics, labor strikes, supply chain interruptions, or any other similar events. Business In Motion – Bag PRO will inform Buyer promptly and take all reasonable measures to minimize disruption.

10. Privacy and Data Protection

Business In Motion – Bag PRO commits to protecting Buyer’s personal information. Personal data collected during transactions will be processed securely, confidentially, and used solely for order fulfillment, communication, and administrative purposes related to Buyer’s purchase. Buyer’s data will not be shared with third parties except as required by law or necessary for order processing. 11. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the State of Texas. Any legal proceedings relating to this Agreement shall be filed in courts located in Tarrant County, Texas.

12. Entire Agreement

This Agreement constitutes the entire understanding between Business In Motion – Bag PRO and Buyer concerning the sale and purchase of goods and supersedes all prior negotiations, representations, or agreements.

By placing an order, Buyer acknowledges having read, understood, and agreed to these Terms of Sale.
